Before being eligible to submit any Employment Pass (EP) applications in 2015, all Malaysian companies registered with the Expatriate Services Division (ESD) online application portal must first submit projections for the number foreign nationals they plan to employ during the year. This new projection requirement was first announced earlier this year and will be an annual requirement for sponsoring companies in Malaysia.
Projections must be made for the following four employee categories:
• Top Management
• Technical Position / Expert
• Middle Management
• Entry Level / Junior Management
Document requirements for these projections are minimal (especially if the company plans to bring in less than 10 foreign nationals in 2015); however, the Malaysian authorities do reserve the right to request further documentation evidencing the company’s need for their projected number of foreign employees.
Companies should note that processing times for the projections to be approved are current 2-3 weeks; thus, it is strongly recommended that projections are submitted as soon as possible to avoid delays in future EP application filings for 2015.
